On August 19, 2015 the owner applied diatomaceous earth onto the puppy to treat for fleas, which the puppy has had for a few weeks. On August 22, 2015 the owner applied Vet Kem spray onto the under labelled aged puppy, which the owner saw the puppy lick some.

On August 22, 2015 the puppy developed anorexia. On August 23, 2015 the puppy developed diarrhea and ataxia. On August 24, 2015 the puppy started vomiting, the owner noticed weight loss, and the puppy's ataxia and diarrhea ended. The owner gave the puppy penicillin (owner gave 1/2 tablet of unknown milligram strength as it was left over from an old dog). A short time later the puppy started retching. Later that evening, the owner contacted the Animal Product Safety Service (APSS). The APSS veterinarian stated if ingested, gastrointestinal (GI) upset and/or a taste reaction may occur. The APSS veterinarian stated with the diatomaceous earth if ingested, risk is for GI upset. The APSS assistant recommended taking the puppy to the veterinarian and having the veterinarian call for information.

The APSS veterinarian stated that the diatomaceous earth was not considered to be related to causing the clinical situation. On August 26, 2015 an APSS technician called the owner to follow up on the case. The owner stated the puppy was not taken to the vet and on August 25, 2015 the puppy died. A necropsy was not available as the body had already been buried. Extra label use-minimum age for treatment is 12 weeks old.
